1. INTRODUCTION AND DEFINITIONS OF TERMINOLOGY

1a. These Terms of Use (also known as “terms of service” and “terms and conditions”, or simply the “Terms”) are rules by which one must agree to abide in order to use the services offered by The Sky is High Crowdfunding (“The Sky is High”).

1b. The Sky is High is a Canadian “sole proprietorship” business entity listed in the Yellowpages directory and registered in Ontario, Canada with the business identification number (BIN) ON-260774534.The URL https://www.theskyishigh.com links to the Site operated by The Sky is High ("We, Our"). The Sky is High is an online crowdfunding venue for people campaigning to raise funds for their own projects and to contribute to the projects of others.

1c. These Terms govern the use of the official website (“Site”) and Services ("Services") belonging to The Sky is High. By using the Site and Services, you indicate that you accept these Terms and that you agree to abide by them. If you do not agree with these Terms, please refrain from using this Site and Services offered by The Sky is High. These Terms should be read along with our Privacy Policy (“Policy”) posted at: https://www.theskyishigh.com/privacy-policy. The Policy governs the handling of data (and personal information) within our Site and Services. If certain business operations are not defined in these Terms, they may be defined in the mentioned Policy.

1d. We may amend the Terms at any time by posting a revised version of the Terms on our Services. Access to or continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the revised Terms.

1e. In these Terms, we refer to those raising funds as "Campaign Owners" and to their fundraising campaigns as "Campaigns." We refer to those contributing funds as "Contributors", their supportive backing action as “Contributing” and the funds which are contributed as "Pledges." Campaign Owners can offer perks or gifts in the form of tangible items or intangible services (collectively, "Rewards") to Contributors. Campaign Owners, Contributors and other guest visitors using the Services are referred to collectively as "Users", (“You”, “Your”). It is possible to sign-up for our Services by registering on our Site and creating a membership account “Profile”. A registered User “Member, (“You”, “Your”), may benefit from various enhanced features embedded within the Services. Registered Campaign Owners and Contributors who are not visiting as guests or Contributing anonymously are referred to collectively as “Members”, (“You”, “Your”).

1f. The Sky is High makes no representations about the quality, safety, morality or legality of any Campaign, Reward or Pledge or the truth or accuracy of User Content (as defined below) posted on the Services. The Sky is High does not represent that Campaign Owners will deliver Rewards or that Pledges will be used as described in the Campaign. Users use the Services at their own risk.

2. PAYMENT GATEWAYS

A major aspect of our Services is the processing of monetary transactions. We use a selection of trusted services (“Payment Gateways”) which are internationally used by businesses to authorize and process transactions. The three Payment Gateways we use are Paypal, Stripe and Coinbase. Each has its own Terms and Privacy Policies which we recommend each Campaign Owner to review.

2a. Payment Gateways
Each of the mentioned Payment Gateways offers us merchant services which we implement for various transaction models within our design. For example we may use Coinbase only for the processing of Bitcoin. We may use Stripe for the processing of recurring charges in subscription models. We may use Paypal for standard “All or Nothing” Campaigns in which funds are collected only if the Campaign goal is met.

PAYPAL – for processing various currencies and payment methods.
STRIPE – primarily for direct credit card processing.
COINBASE – for processing digital currency such as Bitcoin.

2b. Owners that accept these payment gateways and Contributors that use these payment gateways in connection with a Campaign acknowledge and agree to comply with the corresponding payment gateway’s Crowdfunding and Acceptable Use Policies.

2c. A Member’s Profile dashboard allows for authorized connections to be made with the Member’s own account(s) on these payment gateways. Through the dashboard a Member may pre-authorize a payment gateway for transactions with the Services offered by The Sky is High. For more detailed information see section 12d.

3. CROWDFUNDING MODELS

The Sky is High has the standard crowdfunding models available to Members. These sometimes have various names which have been compiled below for comparison:

3a. All or Nothing:
An “All or Nothing” Campaign may also be referred to as “fixed-funding”, “pre-order”, “100% Threshold”, or “pre-authorization”. The Campaign Owner receives funds only if the Campaign goal is reached or surpassed. We use Stripe or Paypal to process these transactions and no guest check-out is available. In terms of visibility on our Services, anonymous contributions are available.

3b. Keep it All:
A “Keep it All” Campaign may also be referred to as “flexible-funding”, “order”, “instant payment”, “immediate delivery of funds”, “authorization”. The Campaign Owner receives funds instantly and keeps all funds received. We use all our available Payment Gateways (Paypal, Stripe and Coinbase) to process these transactions. Guest checkout is also available. In terms of visibility on our Services, anonymous contributions are available.

4. DONATIONS AND SUBSCRIPTIONS

4a. Donations:
A “Donation” may also be referred to as “PWYW” or “pay what you want”. A User or Member may Contribute the minimum contribution required (or more) in order to receive the product associated with that level in any particular Campaign. In this sense a donation can be made. A donation also means that no particular extra reward will be offered for surpassing the minimum amount of Contribution. We also sell standalone products for which donations can be made, in the traditional sense. We use Stripe or Coinbase to process all complex donation transactions. Basic traditional donations may be processed with Paypal (such as a standalone donation button).

4b. Subscriptions:
A “Subscription” can also be referred to as a “recurring payment” or “membership”. We offer standalone products (not as rewards in any campaign) pertaining to our niche crowdfunding model and some of these are the products we offer on a subscription basis. Those Users or Members who wish to support us with recurring payments in return may receive products. For example, we may offer to place a User or Member’s logo and link on a prominent spot on our Services. We use Paypal and Stripe to process subscription transactions which may be weekly, monthly or yearly. Subscriptions cannot be recurring donations in any case. We provide a product in exchange for all subscription amounts.

4c. The Sky is High subscription plans are as follows:

Assistance Subscriptions ($5 each, monthly)

Chat Subscriptions ($5 each, monthly)
- Chat Plasma Power
- Chat QEG
- Chat New Energy

Connection Subscriptions ($5 each, monthly)
- (Not yet available as of the publication date of these Terms)

Sponsorship Subscription
- Logo and Link on Site ($3 weekly)
- Logo and Link on Site ($10 monthly)
- Logo and Link on Site ($100 yearly)

4d. When a Member signs up for a subscription plan, this Member agrees to the following maximum recurring billing frequencies, as soon as the first payment processes:
- 25 times weekly during the weekly subscription
- 6 times monthly during the monthly subscription
- 1 time yearly during the yearly subscription

4e. After this time period the Member may renew or cancel their subscription. The subscription may also be cancelled by the Member at any time. The Sky is High reserves the right to cancel a subscription at any time if the Member fails to comply with the Terms. No refunds are offered for subscriptions. If a special circumstances, a Member may inquire and appeal for a refund directly from The Sky is High.

4f. For Subscriptions (also called “Pre-Approvals”), the Maximum Length of the Agreement is 364 days, the Maximum Transaction Amount is $100 and the Maximum Billing Agreement amount is $100.

5. SKY HIGH PRODUCTS AND SKY HIGH CREDITS

Throughout our Site and Services, aside from our niche crowdfunding operations, our e-commerce implementation offers various products for sale. We process these products with all our available Payment Gateways.

5a. The three types of products we offer are:
Our own Sky High Products
- Standalone Items
o Physical Items
These goods require a shipping address from the User or Member.
Examples: Sky High stickers, Sky High bags, Sky High cameras.
o Virtual Items
These goods are either hosted on our Site or in our Amazon S3 service.
Examples: Sky High documents, Sky High webinar links, Sky High multimedia files.
- Sky High Credits
- Sky High Subscription Plans
- Sky High Donation Buttons
- Free Sky High Products (such as those received upon registration).

New Energy Technology related products
Various available builder items and prototyping products. We may sell products belonging to other individuals or companies. These may be translated texts, small parts, system parts, etc. These are carefully selected by us to comply with the technological conditions and criteria defined in our Terms.

Affiliate products
Select products from the open-source communities we are affiliated with. These are carefully selected by us to comply with the technological conditions and criteria defined in our Terms.

5b. Sky High Credits
Credits may be understood as our own Site-specific virtual currency. These may be received as gifts, purchased separately, received through a product purchase, offered as bonuses, collected and exchanged for products and services on The Sky is High. The Sky is High strives to offer the motivation, skills and co-financing to builders of New Energy Technologies and our Sky High Credits are a way of offering special assistance in individual cases. We may offer and revoke certain Sky High Credits if their use by our Members does not comply with our Terms. Once purchased, Sky High Credits remain as virtual goods only and may not be exchanged back into any other currency.

5c. Sky High Credit details
A new Member receives 5 Sky High Credits upon registration.

All Sky High Product Purchases add Sky High Credits of varying amounts to purchasing Member’s Sky High dashboard account.

All Sky High Products have a Sky High Credit value for which they may also be exchanged. We reserve the right to alter cost of acquiring Sky High Products and offer these at either more or less than their Sky High Credit values, as per our e-commerce implementation.

The Sky High 250 Credit Pack is offered for $100USD as one of the possible methods a Member can move in the Pathway Membership levels from the “Builder” to the “Fellow” level.

The approximate equivalent value of one Sky High Credit is less than $0.50USD. Therefore our Sky High 250 Credit Pack is valued at no more than $100USD.

6. REGISTRATION LOGISTICS AND USE OF SERVICES

Any Internet User may freely browse our Site and Services at no cost. A User may sign-up and thus register in order to receive more direct and focused assistance in the niche specialization of the Services offered by The Sky is High. Upon registration a User’s account is formed (now a Membership account called a Profile). This Profile may be accessed by means of a login page by the User (now a Member) at any time. On the Profile the Member may see notices, offers and a summary of their involvement in the crowdfunding community at The Sky is High, such as created and backed campaigns.

6a. By means of the Profile dashboard, a Member may choose to download free or paid virtual goods, create campaigns, select other paid products, upgrade memberships (if applicable), purchase or redeem credits.

6b. The primary focus of Services at The Sky is High are the crowdfunding Campaigns. Once a Member submits a Campaign it is held for review until the Member and Campaign is verified to comply with our Terms and Policy. We review the Campaign within 24 hours. We may also conduct general IP checks and manual sanctions watchlist scanning of individual data. Once approved, the Campaign is launched and thus it becomes visible to other Users. At that point Users and Members may Contribute to the Campaign.

The Campaign Owner may direct the capturing of funds for their Campaign by authenticating their selected payment gateway in their profile settings. All of the Payment Gateways and Crowdfunding Models used by The Sky is High may also be used by registered Members. The chosen crowdfunding model will decide on the type of processing of funds by the Payment Gateway. This is described in greater detail in section 2.

7. ELIGIBILITY

To sign up for a Profile on The Sky is High, you need to be at least 18 years old. This is because our primary service is crowdfunding for which a User or Member must own verified financial accounts. In order for a User or Member to link a funding method with any of our payment gateways (Paypal, Stripe, Coinbase) or to purchase or sell digital currency, the User or Member must be at least 18 years old. If necessary, we may ask for proof of age. Users between the ages of 13 and 17, may only browse the Services with the consent and supervision of a parent or legal guardian who is at least 18 years old, provided such parent or legal guardian also agrees to be bound by the Terms and agrees to be responsible for the appropriate use of the Services. Users suspended from using the Services are not eligible to use the Services. The Sky is High reserves the right to refuse use of the Services to anyone and to reject, cancel, interrupt, remove or suspend any Campaign, Pledge, or the Services at any time without liability, especially if the Member or their Campaign(s) fail(s) to comply with the Terms, the campaign review or general verification process.

8. THE SKY IS HIGH AS A STANDALONE ORGANIZATION

The Sky is High is not connected with any other business or organization. We use extensive open-source information which is significant in the New Energy technologies domain. We may post exact copies of the original material, always informing the source and linking back.
8a. The addition of open-sources is rare (as of April 2017) and their number is currently at three:

9. CREATING CAMPAIGNS: BASICS

The Sky is High provides a funding platform for New Energy Technology Campaigns. When a Campaign Owner creates a Campaign on The Sky is High it is an invitation for other people to form a contract with them. Anyone who backs a Campaign is accepting the Campaign Owner’s offer, and forming that contract.

9a. The Sky is High is not a part of this contract — the contract is a direct legal agreement between Campaign Owners and their Contributors. The Sky is High is also not directly involved in the transaction between Campaign Owners and their respective Contributors.

9b. When a Campaign is successfully funded, the Campaign Owner must complete the Campaign and fulfill each reward if these are a part of the Campaign. Once a Campaign Owner has done so, they’ve satisfied their obligation to their Contributors.

9c. Throughout the process, Campaign Owners owe their Contributors a high standard of effort, honest communication, and a dedication to bringing the project behind the Campaign to life. At the same time, Contributors must understand that when they back a Campaign, they’re helping to create something new. There may be changes or delays, and there’s a chance something could happen that prevents the Campaign Owner from being able to finish the Campaign as promised.

9d. If a Campaign Owner is unable to complete their Campaign and fulfill rewards, they’ve failed to live up to the basic obligations of this agreement. To right this, they must make every reasonable effort to find another way of bringing the Campaign to the best possible conclusion for Contributors. The Campaign Owner is solely responsible for fulfilling the promises made in their Campaign. If they’re unable to satisfy the terms of this agreement, they may be subject to legal action by Contributors.

10. CRITERIA AND CONDITIONS OF CAMPAIGN TECHNOLOGIES

The technology must be:
- New Energy (see CSETI’s Summary of Break-Through Energy Technologies – prepared for: The President of the United States and Members of the US Congress). It is noteworthy that CSETI released a disclosure on April 24th, 2017. See the new film “Unacknowledged” (2017).
- One of the selected open source technologies listed on our website, or any other public open-sourced technology being developed internationally with at least similar proven measurable results and public acknowledgement. Only campaigns supporting the ongoing research and development of working open-sourced new energy technologies are acceptable.
- Not an existing renewable energy source such as hydro, solar, wind, biomass, geothermal or nuclear.
- Safety approved: no bio-hazards, no telecom disruption, no harmful radiation.

10a. The following technological conditions should apply on the most part, and the rest should be in at least a research phase in order to make all the conditions applicable.

Technological conditions:
- Reproducible from fabrication and engineering plans.
- Economically viable for mass production.
- Non-rare materials must be used.
- Runs 12 hours.
- Robust easy on/off.
- Operable anywhere.
- No dependence on wind, sun etc.
- Self-running and closed-loop.
- Output runs input while device powers 1Kw +
- Over-unity
- Zero-point / quantum vacuum source.

10b. General conditions:
- Transnational collaboration
- Open-sourcing – no patents
- No single ownership.
- Live public broadcasting of transparent testing by a professional independent 3rd party verification team.

10c. Accepted corresponding psychological and social conditions:
- Practice of collaborative physics (sharing knowledge of advanced sciences), based on universal laws of nature, observable by direct personal experience
- Practice of the positive use of the technology: humanitarian, ecological sustainability, universal goodwill.
- Practice of decentralized Close-Encounters of the Fifth Kind (CE-5): mutual, bilateral communication with Extraterrestrial Intelligence (ETI).
- Practice of massive disclosure with evidence: defection of witnesses, victims and perpetrators.
- Practice of localized grassroots and globally interconnected self-sufficient systems, compassionate social support for the transitioning high-tech sector as it moves into the domain of New Energy Technologies.

10d. The following are links to official technological criteria which must be met in order to have a valid New Energy device, as indicated by witness testimony and the 25 years of work by the CSETI organization.

11. CREATING CAMPAIGNS: DEEPER DESIGN

Our campaign creation process is simple. Register on our platform and create a Campaign for free. Create as many Campaigns as you wish (up to four Campaigns per year if using Paypal as a payment gateway). If the Campaign complies with our review then we can offer approval within 24 hours and launch your campaign at that time. If your Campaign is declined by us, we may provide feedback to make it happen. The campaigns must be measurable, achievable, realistic and clear in the sense of communication.

11a. All campaigns are in US Dollar funds ($ USD) and processed with various corresponding payment gateways according to the selection and needs of our Users and Members. There are automated features which allow a campaign creator to select their currency of choice. United States Dollars ($ USD) are globally displayed throughout The Sky is High Services for greater ease of use.

11b. Our Payment Gateways have varying Terms of Use of their own. Through our review process and platform API code automation we apply the corresponding payment gateways for each campaign.

12. LOGISTICS OF MERCHANT SERVICES COMPLIANCE

12a. The following are our general platform details delivered to comply with our multiple Payment Gateway merchant services regulations:

- Our platform accepts both standard "Keep it All" and "All or Nothing" campaigns.
- All Campaigns offer rewards/incentives. These are perks, small items such as a postcard, digital download or an opportunity to exchange information more directly.
- Rewards will be less than $100 in value each.
- Average funding goal estimate is $5000.
- A maximum donation per contributor is $2000.
- The average transaction amount is expected to be a niche platform standard of less than $25.
- The average monthly volume is expected to be a niche platform standard of less than $5000.
- The percentage of annual revenue from sales is expected to be a niche platform standard of less than 25%.
- The maximum project duration is 90 days.
- A project creator can have 2 projects active at any one time.
- The annual limit of projects per creator is 4.
- A contributor can contribute up to 4 times per project.

12b. Verification of Campaign Owner and Sanctions Watchlist Scanning:

We will be vetting project creators in the following way:

- We need to know the country of origin of the project creator at registration
- We review (pre-screen) the campaign.
- We may verify if the Internet Protocol matches the country of registration of any particular User or Member.
- We conduct manual sanctions scanning based on available public watchlists in our business jurisdictions. In the future we plan to automate sanctions scanning by API code with a corresponding services provider.
- We can only accept payments from countries which our payment gateways can accept.

12c. Pathway Memberships:

In our crowdfunding niche, the selected technology has to comply with the various conditions listed in section 10. The project creator needs to be working on a phase of development that is identifyable by members of the selected open-source community.

The First Campaign must have a maximum Campaign Amount Goal of $500 USD:
A Campaign Owner’s clearance for larger Campaigns is enabled with a proven track record of one successful Campaign. Once a Campaign Owner has documented a high standard of work with this crowdfunded amount, they can begin with greater amounts. This lowers the many risks of potentially inappropriate New Energy Campaigns. When the public sees that a Campaign Owner has a proven track record and is making progress, there is a higher chance of funding for further development. Thus, in order to crowdfund anything over $500 USD, a Campaign Owner must provide documentation of work within their campaign, most often in the form of updates. The incremental funding amounts are as follows: $500 – $5000 – $50,000 USD.

If our business and operations necessitate higher Campaign limits at any point in the future, we will contact our Payment Gateways for approval, revise these Terms if approved, and notify our Members and Users of the Site and Services.

12d. Upon registry a User becomes a Member and is admitted into a level 1 membership as a “Founder”. For all levels, the available services and features are visible in the Member’s Profile dashboard and organized for distinct accessability in the Profile menu. To launch a Campaign, a new Member must complete the following process:
- Opt-in by selecting “Become a Creator” within their Profile.
- Reload the Profile dashboard.
- Create a Campaign and wait for Campaign Approval.
- Connect their own preferred Payment Gateways to their Profile on The Sky is High from within the Profile dashboard.
- Once the Campaign Owner is verified and has connected their Profile with a Payment Gateway, and if the Campaign is approved, the Campaign Owner may start collecting funds from Contributors.

12e. The Sky is High Membership Levels:

A User may freely browse the Site and Services but is limited to what is public. Membership levels unlock features which assist those who are at corresponding stages in their build programs.

“Founder” (Level 1 Membership) Features:
- Free Registration
- Basic $500 Campaign Limit
- Assortment of Top Public Documents
- Introductory Product Selection
- Sky High Credit Availability
- Access to additional selected level 1 campaigns
Upgrade Pathway (to the next “Builder” Level):
- 1 Successful Campaign with a minimum of $450 raised.

“Builder” (Level 2 Membership) Features:
- All “Founder” Level Features
- Extended $5000 Campaign Limit
- Sky High Product Affiliation
- Extended Product Selection
- Access to additional selected level 2 campaigns
Upgrade Pathway (to the next “Fellow” Level):
- A positive track record of 3 Campaigns of at least $250 raised in each and one of the following: Subscription (Weekly or Monthly or Yearly), Sky High 250 Credit Pack ($100 value), or a minimum $50 Donation to The Sky is High.

“Fellow” (Level 3 Membership) Features:
- All “Builder” Level Features
- Advanced $50,000 Campaign Limit
- No Platform Fees (Waived)
- Advanced Campaign Categories
These must be relevant to New Energy Technologies in some way: “Any Open-Source Technology” (ie. FabFi), and “Any Open-Source Ecologically Sustainable Project” (ie. rocket mass heaters).

- Advanced Product Selection
- Access to additional selected level 3 campaigns
Upgrade Pathway (to the top “Sky High” Level):
- Successful campaign creation track record with build phase credibility, a demonstration of the awareness of the issues surrounding New Energy Technologies, a collaborative and co-creative spirit on The Sky is High.

“Sky High” (Level 4 Membership) Features:
- (Not yet available as of the publication date of these Terms)
- All “Fellow” Level Features
- A role in the vision of the platform, and more.
- Access to all campaigns

We say, “Practice small and learn to go big, learn the power of crowdfunding along the way. “ The sky is high.

12f. The Campaign Owner supplies information about:
- Technology
- Category
- Aim
- Funding Amount (starting with $500 USD maximum)

- Type of funding
- Rewards to Contributors
- Images

- Funding Type (“Keep It All”, “All or Nothing”)
- Reward-based Campaign or Donation-based Campaign (Paypal not available for later)
- Customization of Pledge Form, Thank You Response, transactional emails
- Information needed from a Pledge Contributor (for example an email for contact)

12g. The Campaign Owner provides transparency with:
- Audio-visual documentation
- Contact information
- Connections (social media etc.)

- Sources of information

12h. The Campaign Owner can create a Campaign in any of the following categories:
- Immediate Needs
- Translations
- Organization and Development
- Material supply
- Build Phase
- Live streaming
- Consulting
- Manufacturing
- Installation
- Servicing
- Workshop
- Lab space
- Technician
- Equipment
- Contest
- Conference
- Event

13. USER’S AND MEMBER’S INTELLECTUAL PROPERTY

We don’t own the stuff you post on The Sky is High. But when you post it, you’re giving us permission to use or copy it however we need in order to run the site, or show people what’s happening on it. The Sky is High doesn’t own content you submit to us (your “Content”). But we do need certain licenses from you in order to perform our Services.

13a. Applicable Terms for the Campaign and Campaign Owner:
When you submit a Campaign for review, or launch a Campaign, you agree to the following terms:

- We can use the content you’ve submitted. You grant to us, and others acting on our behalf, the worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sub-licensable, transferable right to use, exercise, commercialize, and exploit the copyright, publicity, trademark, and database rights with respect to your Content.
- When we use the content, we can make minimal adjustments without interpretation or changing the meaning of the content, such as in editing spelling mistakes and repetitive words. You grant us the right to edit, modify, reformat, excerpt, delete, any of your Content. We will contact you if any significant alterations need to be made. This is a part of the process of submitting a Campaign for review.
- You won’t submit stuff you don’t hold the copyright for (unless you have permission).
- Your Content will not contain third-party copyrighted material, or material that is subject to other third-party proprietary rights, unless you have permission from the rightful owner of the material, or you are otherwise legally entitled to post the material (and to grant The Sky is High all the license rights outlined here).
- Any royalties or licensing on your Content are your responsibility. You will pay all royalties and other amounts owed to any person or entity based on your Content, or on The Sky is High’s hosting of that Content.
- You promise that if we use your Content, we’re not violating anyone’s rights or copyrights. If The Sky is High or its users exploit or make use of your submission in the ways contemplated in this agreement, you promise that this will not infringe or violate the rights of any third party, including (without limitation) any privacy rights, publicity rights, copyrights, contract rights, or any other intellectual property or proprietary rights.
- You’re responsible for the stuff you post. All information submitted to the Site, whether publicly posted or privately transmitted, is the sole responsibility of the person from whom that content originated.
- We’re not responsible for mistakes in your content. The Sky is High will not be liable for any errors or omissions in any content.

14. THE SKY IS HIGH'S INTELLECTUAL PROPERTY

The content on The Sky is High is protected in various ways. You do have the right to use it for certain personal purposes, but you can’t use it for anything commercial without getting permission first.

15. FUNDING: FOR CAMPAIGN OWNERS AND CONTRIBUTORS

The Estimated Delivery Date is the Campaign Owner’s estimate. The date listed on each reward is the Campaign Owner’s estimate of when they will provide the reward — not a guarantee to fulfill by that date. The schedule may change as the Campaign Owner works on the Campaign. We ask Campaign Owners to think carefully, set a date they feel confident they can work toward, and communicate with Contributors about any changes.

15a. The Campaign Owner may need to send you questions about your reward. To deliver rewards, the Campaign Owner might need information from you, like your mailing address or t-shirt size. They’ll request that information after the campaign has succeeded. To receive the reward, you’ll need to provide the information in a reasonable amount of time.

15b. Responsibility for finishing a Campaign lies entirely with the Campaign Owner. The Sky is High doesn’t hold funds on the Campaign Owners’ behalf, and cannot guarantee the Campaign Owners’ work.

15c. Applicable Terms for the Campaign Owner:
The Sky is High acts as an intermediary between you and Contributors and other Users of the Site. When you register a Campaign with The Sky is High, you represent, warrant and undertake to The Sky is High and all users of the Site that:
- You are 18 years of age or older;
- You are the person with ultimate responsibility for the Campaign (or are otherwise acting with the express authority of that person);
- You will obtain, maintain and renew (as applicable) any necessary approval, authority, consent, licence or any other permissions in relation to your use of the Services to achieve funding for the Campaign and comply with all applicable laws;
- You will apply all Contributor pledges received in accordance with the Campaign’s stated aims;
- You will not offer securities/financial instruments in return for Contributor pledges;
- You will not misuse any Contributor pledges, including not using any monies pledged for purposes which are not stated aims of the Campaign;
- You may need to set up a payment gateway account with Paypal, Stripe and/or Coinbase and comply with all associated terms and procedures.

15d. Do not assume you’ll be able to launch your Campaign when you want; there could be a reason we’re not able to accept it, or a problem that takes time to resolve. Don’t assume you’ll be able to immediately collect your funding; there may be a delay between the end of a successful campaign and your access to the funds. And don’t take any actions in reliance on collecting any of the money pledged until you actually have the ability to withdraw it from your account and spend it.

15e. The Campaign Owner may refund individual pledges if applicable. Contributors may request a refund from Campaign Owners up to 24 hours before the end of a Campaign. If this is the case and the refund is approved then the Campaign Owner has no further obligation to that specific Contributor. At that point the agreement ceases to exists between the Campaign Owner and the Contributor.

15f. Pledges are eligible for a refund by Campaign Owner unless (a) the Pledge funds have already been transferred to the Campaign Owner, (b) the Reward associated with the Pledge has been fulfilled, or (c) The Sky is High determines that there has been an abuse of these Terms of Use. The Sky is High reserves the right to terminate User Accounts and remove Campaigns for any abuse of this refund policy. For Campaigns that have ended, or in situations where the Pledge funds have been transferred to the Campaign Owner, Contributors should contact the Campaign Owner directly regarding refunds.

15g. Applicable Terms for the Campaign Contributor:
For a “Keep It All” Campaign your payment processes immediately and the Campaign Creator receives funds instantly (or as soon as the payment processes).

15h. For an “All or Nothing” Campaign you’re only charged if the Campaign reaches its fundraising goal. You’ll provide your payment information when you pledge, but you won’t be charged. Your payment will only be collected if, at the time of the Campaign’s funding deadline, the Campaign has reached its fundraising goal. The exact amount you pledged is the amount (minus any fees you may be charged outside of The Sky is High – such as a banking fee for currency conversion) the Campaign Owner will collect (minus their fees). If the campaign hasn’t reached its fundraising goal, you won’t be charged, no funds will be collected, and no money will be transferred anywhere.

15i. The Sky is High recommends that you check the Campaign Owner’s biography and history on the Site for background information and do your own research before pledging. The Sky is High is a venue and as such is not responsible or liable for any content, for example, data, text, information, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other members, or outside parties on The Sky is High. You agree that the use of The Sky is High Services is at your own risk.

16. COMMERCE AT THE SKY IS HIGH

We wish that this Service could be financially accessible to everyone. At the moment the financial back-end of the platform charges standard crowdfunding platform fees from us, so we must take a percentage from our clients. At the moment The Sky is High is not able to offer free services. With this work we support our personal lives. We do understand that the “free energy” domain is filled with scams, trolling, lies, and misinformation. We also understand that the “free energy” domain is also the New Energy Technologies sector which is emerging with real communities of people building transitional working prototypes of open-sourced devices, units and systems from beyond the understanding of popular physics, that it is a collaborative business paradigm, that there is truth behind the matter – as can be seen from top level witness testimony in military, government, corporate and industrial positions. That is why we plan to transparently publish all we do in our line of work as per the conditions of the transnational disclosure movement. See our [ Commerce ] page for details.

17. CAMPAIGN FEES

Creating an account on The Sky is High is free. Creating a Campaign is free. If a Campaign Owner creates a Campaign that receives contributions or is successfully funded, we and our Payment Gateways collect fees. Our Payment Gateway’s fees may vary slightly based on the registered Campaign Owner’s jurisdiction. See the Fees section on our [ Commerce ] page for more details.

17a. If using Bitcoin as a funding currency for a Campaign, no fees are deducted at any time by either the Payment Gateway (Coinbase), or The Sky is High.

17b. For a “Keep it All” Campaign, the 5% platform fee is charged per each Contribution transaction. If using Stripe, the Campaign Owner is deducted the 2-4% merchant services fee per each Contribution transaction. If using Paypal, the Platform Owner is deducted the 2-4% merchant services fee per each Contribution transaction.

17c. For “All or Nothing” Campaigns, fees are only charged if the Campaign reaches its goal. The Sky is High charges 5% of the campaign amount ($50 for every $1000 successfully raised). Payment Gateways charge between 2-4% of the final campaign amount ($20-$40 for every $1000 successfully raised).

17d. The Campaign Owner may also have to pay local taxes on the final campaign amount. For 10% taxes this would be $100 for every $1000 successfully raised.

17e. The Campaign Owner may also have to pay local banking fees such as currency conversions and transfers. This may be $10 for every $1000 successfully raised.

17f. The Campaign Owner collects the amount raised minus the fees mentioned in 14a or 14b, 14c, and 14d. In this example, $200 is taken for fees and taxes for every $1000 successfully raised. Due to such fees it is a good idea to plan a 20% higher campaign amount than the actual needed funds.

17g. The Sky is High does not charge processing fees for Campaigns on the Site other than the above mentioned standard 5% for “Keep it All” transactions or the standard 5% for successful “All or Nothing” Campaigns.

17h. We will not collect any fees without giving you a chance to review and accept them. If our fees ever change, we’ll announce that on our Site. Some funds pledged by Contributors are collected by Payment Gateways (the percentage fees). Each Payment Gateway is its own company, and The Sky is High isn’t responsible for the performance of Payment Gateways (such as Paypal, Coinbase, Stripe, etc.).

17i. The Campaign Owner is responsible for paying any additional fees or taxes associated with their use of The Sky is High as their crowdfunding venue for open-sourced New Energy Technologies.

17j. We’ll charge our fees before putting funds in your account. The Sky is High and its Payment Gateways will subtract fees before transmitting the proceeds of a campaign.
Some pledges can’t be collected, which might reduce the amount of funding you get. Because some payments can’t be collected — for instance, when a Contributor’s credit card expires before funding ends, and they don’t provide updated information — we can’t guarantee that the amount of funding you receive will be exactly equal to the full amount pledged minus fees.

17k. The Sky is High does not, at any time, receive or hold any monies intended for Campaign Owners. All funds are collected for Campaign Owners by our payment gateways. The Sky is High is not responsible for the performance or fairness of its payment gateway service providers, and The Sky is High is not responsible for any payment gateway fees. Given the occasional failures of some credit cards, The Sky is High cannot guarantee the full receipt of the funding target.

18. ADDITIONAL TERMS AND INFORMATIONAL DETAILS

18a. OUR RIGHTS
The Sky is High reserves these rights:
- We can make changes to the Site and Services without notice or liability.
- We have the right to decide who’s eligible to use The Sky is High. We can cancel accounts or decline to offer our Services. (Especially if you’re abusing them.) We can change our eligibility criteria at any time. If these things are prohibited by law where you live, then we revoke your right to use The Sky is High in that jurisdiction.
- We have the right to cancel any pledge to any Campaign, at any time and for any reason.
- We have the right to reject, cancel, interrupt, remove, or suspend any Campaign at any time and for any reason.
- The Sky is High is not liable for any damages as a result of any of these actions, and it is our policy not to comment on the reasons for any such action.

18b. WARRANTY DISCLAIMER
We work hard to provide you with great services, but we can’t guarantee everything will always work perfectly. This site is presented as-is, without warranties. You use our Services solely at your own risk. They are provided to you “as is” and “as available” and without warranty of any kind, express or implied.

18c. THE SKY IS HIGH SPECIFICALLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE. NO ADVICE OR INFORMATION (ORAL OR WRITTEN) OBTAINED BY YOU FROM THE SKY IS HIGH SHALL CREATE ANY WARRANTY.

18d. IDEMNIFICATION
If you do something that gets us sued, or break any of the promises you make in this agreement, you agree to defend, indemnify, and hold us harmless from all liabilities, claims, and expenses (including reasonable attorneys’ fees and other legal costs) that arise from or relate to your use or misuse of The Sky is High. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to this indemnification clause, in which case you agree that you’ll cooperate and help us in asserting any defenses.

18e. OUR LIABILITY
The material displayed on this Site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

- All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
- Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results or the use of this Site, any websites linked to it and any materials posted on it, including, without limitation any liability for:
- Loss of income or revenue;
- Loss of business;
- Loss of profits or contracts;
- Loss of anticipated savings;
- Loss of data;
- Loss of goodwill;
- Wasted management or office time;
and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

18f. This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraud or fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.

18g. DELETING MEMBERSHIP ACCOUNT
A Member can delete their account at any time.

18h. LIMITATION OF LIABILITY
- If something bad happens as a result of your using The Sky is High, we’re not liable beyond a small amount.
- To the fullest extent permitted by law, in no event will The Sky is High, its directors, or content providers be liable for any indirect, incidental, punitive, consequential, special, or exemplary damages of any kind, including but not limited to damages (i) resulting from the User’s access to, use of, or inability to access or use the Services; (ii) for any lost profits, data loss, or cost of procurement or substitute goods or services; or (iii) for any conduct of content of any third party on the Site. In no event shall The Sky is High’s liability for direct damages be in excess of (in the aggregate) one hundred U.S. dollars ($100.00).

18i. Dispute Resolution and Governing Law:
The Sky is High is located in Ottawa, Ontario, Canada, and any disputes with us have to be handled in Ontario under Ontario law.

18j. STUFF WE ARE NOT RESPONSIBLE FOR
We do not oversee Campaign performance, and we don’t mediate disputes between users.

18k. OTHER WEBSITES
If you follow a link to another website, what happens there is between you and them.

19. SECURITY

We have implemented SSL security features throughout our Site. As of May 2017 we will be using business-level 2048-bit+ (G5) SSL EV certification with a SHA-2 (256) data security encryption algorithm within our Site and selected Services. This provides for a secure and encrypted connection between our website and the User’s computer (Internet browser). This is also described in our [ Privacy Policy ] and on our [ Security ] page.

20. PROHIBITIONS FOR CAMPAIGNS AND REWARDS

20a. Prohibited Campaigns
Campaign Owners are not permitted to create a Campaign to raise funds for illegal activities, to cause harm to people or property, or to scam others. If the Campaign is claiming to do the impossible or it's just plain phony, don't post it. We can’t post it. Users must comply with all applicable laws and regulations in connection with their Campaigns, including offering Rewards and using Pledges. Campaign Owners shall not make any false or misleading statements in connection with their Campaigns.

20b. Prohibited Rewards
Campaign Owners are not permitted to offer or provide any of the following as a Reward:
- any form of "security"
- any form of financial incentive or participation in any profit sharing;
- any alcoholic consumer products
- any controlled substance or drug paraphernalia;
- any weapons, ammunition and related accessories;
- any form of lottery or gambling;
- any form of air transportation; or
- any items promoting hate, discrimination, personal injury, death, damage, or destruction to property; or
- any items (a) prohibited by applicable law to possess or distribute, (b) that would violate applicable law if distributed, or (c) that would result in infringement or violation of another person's rights if distributed.

21. GENERAL PROHIBITIONS ON OUR SITE AND SERVICES

Please do not lie, break laws, abuse people, steal data, hack other people’s computers, and so on. The Sky is High is not a place for hatred, abuse, discrimination, disrespect, profanity, meanness, harassment, or spam. The Sky is High reserves the right to remove Campaigns and terminate User Accounts for prohibited activities.

- Do not use the Services to promote violence, degradation, subjugation, discrimination or hatred against individuals or groups based on race, ethnic origin, religion, disability, gender, age, veteran status, sexual orientation, or gender identity;
- Do not post images or videos that are sexually explicit or post links to sites that contain sexually explicit material or show people or animals being hurt or degraded;
- Do not spam the comments sections or other Users with offers of goods and services or inappropriate messages;
- Do not engage in any activity that interferes with or disrupts the proper working of the Services or any activities conducted on the Services; or
- Do not take any action that imposes, in The Sky is High’s sole discretion, an unreasonable load on The Sky is High's infrastructure.
- Do not represent products created by others as your own creation, or act as a reseller of other’s products.
- Do not use our Payment Gateway services for activities that "...involve the sales of products or services identified by government agencies to have a high likelihood of being fraudulent." Unfortunately there appears to be much fraud in the New Energy Technologies research and development sector. This is why The Sky is High only supports Campaigns which are open-sourced and documented transnationally to a high level of authentic credibility. See section 10 for technological references.

21a. No attack vectors are permitted:
- False promises of funding
- Stealing Ideas
- Traps of skeptics, experts and never-ending debate, distraction through the misunderstanding of new age and occult activities
- Accusation, hatred and smear campaigns
- Bribery
- Distraction with something “better”
- Laziness and disregard
- Excessive wiseacering

22. VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse this Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful (together “Viruses”). You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to this Site. You must not attack this Site via a denial-of-service attack.

22a. By breaching this provision, you may commit a criminal offence under the Computer Misuse Act 1990. We can report any such breach to the relevant law enforcement authorities and we can co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your rights to use this Site will cease immediately.

22b. We will not be liable for any loss or damage caused by a denial-of-service attack or Viruses that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Site or to your downloading of any material posted on it, or on any website linked to it.

23. NOTE ABOUT OFFICIAL TERMS

These Terms and the other material referenced in them are the entire agreement between you and The Sky is High with respect to the Services. They supersede all other communications and proposals (whether oral, written, or electronic) between you and The Sky is High with respect to the Services and govern our future relationship. If any provision of these Terms is found to be invalid under the law, that provision will be limited or eliminated to the minimum extent necessary so that the Terms otherwise will remain in full force and effect and enforceable. The failure of either you or The Sky is High to exercise any right provided for in these Terms in any way won’t be deemed a waiver of any other rights.

23a. These Terms are personal to the User, Campaign Owner and Contributor. The User, Campaign Owner and Contributor can’t assign these terms, transfer them, or sublicense them unless they obtain The Sky is High’s prior written consent. The Sky is High has the right to assign, transfer, or delegate any of its rights and obligations under these Terms without your consent. The Sky is High will provide the User, Campaign Owner and Contributor a notice via email, written notice, or by conspicuously posting the notice on our Site.

23b. Variations
We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.

The Sky is High Crowdfunding (“The Sky is High”) is a Canadian “sole proprietorship” business entity registered in Ottawa, Canada with the business identification number (BIN) 260774534.The URL https://www.theskyishigh.com links to the official website (“Site”) operated by The Sky is High ("We, Our"). The Sky is High is an online crowdfunding venue for people campaigning to raise funds for their own projects and to contribute to the projects of others.

This Privacy Policy (the "Policy") governs the handling of data (especially personal information) by The Sky is High, its Site and all related Services (the "Services"). We will protect all information we receive in accordance with this privacy policy.

This page is the Policy by which you may use the Site and Services. By using the Site and Services, you indicate that you accept this policy and that you agree to abide by it. If you do not agree with this Policy, please refrain from using this Site. In this policy, we refer to those raising funds as "Campaign Owners" and to their fundraising campaigns as "Campaigns." We refer to those contributing funds as "Contributors", their supportive backing action as “Contributing” and the funds which are contributed as "Pledges." Campaign Owners can offer perks or gifts in the form of tangible items or intangible services (collectively, "Rewards") to Contributors. Campaign Owners, Contributors and other guest visitors using the Services are referred to collectively as "Users", (“You”, “Your”). It is possible to sign-up for our Services by registering on our Site and creating a membership account “Profile”. A registered User “Member, (“You”, “Your”), may benefit from various enhanced features embedded within the Services. Registered Campaign Owners and Contributors who are not visiting as guests or Contributing anonymously are referred to collectively as “Members”, (“You”, “Your”).

WHAT PERSONAL INFORMATION WE COLLECT (OR YOU MAY PROVIDE)

You may browse the Services freely (at no cost) and even Contribute anonymously to certain Campaigns. Our membership Services and products are offered as assistance for developing working New Energy Technologies. In order for you to create an account on The Sky is High and use our services, we need to collect and process some information during the registration process. Depending on your use of the Services, that may include:

- information (such as your name, email and postal addresses, telephone number, and country of residence) that you provide by completing forms on The Sky is High, including if you register as a user of the Services, subscribe to our newsletters, upload or submit any material through The Sky is High, or request any information;
- your login and password details, in connection with the account sign-in process;
- details of any requests or transactions you make through the Services;
- information about your activity on and interaction with The Sky is High, such as your IP address and the type of device or browser you use;
- communications you send to us (for example, when you ask for support, send us questions or comments, or report a problem);
- information that you submit to The Sky is High in the form of comments, contributions to discussions, or messages to other users.

PERSONAL INFORMATION GIVEN BY CAMPAIGN OWNERS

If you create a Campaign, you may provide us with the following Personal Information in addition to the Personal Information you provide when you register to be a Member:

- legal person or business information
- corresponding Payment Gateway e-mail address or connecting information for authenticating various transaction processes such as receiving Contributions and forwarding platform fees.
- Stripe account information (if accepting payments via Stripe)
- Coinbase account information (if accepting payments via Coinbase)
- PayPal account information (if accepting payments via PayPal)

PERSONAL INFORMATION GIVEN BY CONTRIBUTORS

As a Contributor, you may provide:

- name
- email address
- Ship-to information
- billing name and address
- corresponding Payment Gateway e-mail address or connecting information for authenticating the transaction(s)

USER AND MEMBER ACCESS, CHOICE, AND MODIFICATION OF PERSONAL INFORMATION

You may decline to submit Personal Information to us; in which case, you may not be able to become a Member with a Profile or use certain Services.

If your Personal Information changes, you may correct, update, amend, remove, or ask to have it removed by making the change on your Profile, or by contacting us at info@theskyishigh.com. Upon request we will provide you with information about whether we hold any of your personal information. If you no longer desire our service, you may deactivate/delete your account entirely from the Profile, or contact us directly at info@theskyishigh.com.

HOW WE STORE AND PROTECT YOUR PERSONAL INFORMATION

WHAT PERSONAL INFORMATION IS SHARED ONLY WITH CAMPAIGN OWNERS

When you Contribute to a Campaign, the Campaign Owner will know your account name, the amount you have contributed (Pledge), and the Reward you have selected. Campaign Owners never receive Contributors’ credit card details or other payment information.

When you Contribute to a Campaign, the Campaign Owner receives the email address associated with your account on The Sky is High. They may also send you a survey requesting information needed to provide your Reward. (For instance, they may need your mailing address, or T-shirt size.) Any information you provide in such surveys will be received by the Campaign Owner.

WHAT PERSONAL INFORMATION IS PUBLIC

Your name and location are publicly displayed in your profile page. To request removal of your personal information from these areas of the site, contact us at info@theskyishigh.com. The profile you create on our site will be publically visible. Specific actions on the site provide you the option of anonymity.

When you create an account, we create a basic Profile page for you on The Sky is High, containing your account name, the date the account was created, and a list of projects you have Contributed to or launched. Whenever your account name appears on The Sky is High (for instance, when you post comments, send messages, or Contribute to Campaigns), people can click your account name to see your Profile. Your Profile is not searchable on The Sky is High or via search engines. Here are some of the things that will be publicly viewable on your Profile, or elsewhere on The Sky is High:

- the account name, and the date it was created
- any information you choose to add to your Profile (like a picture, bio, or your location)
- projects you've Contributed to (but not Pledge amounts or Rewards chosen)
- Campaigns you've launched
- any comments you’ve posted on The Sky is High

Please note that each Campaign page lists Contributors who have Contributed to the Campaign. If you don’t want others to see your name or Profile image on a Campaign’s Contributor’s tab, choose an account image or name that is not identifiable.

HOW WE USE YOUR PERSONAL INFORMATION

We use your Personal Information to operate, maintain, and provide to you the Service and conduct our business.

- Register as a Member and to identify you when you sign-in to your account
- enable us to provide you with the Services;
- administer your account or funds with us;

We take securing your data and preserving your privacy very seriously. We never post anything to your Facebook, Twitter, or other third-party accounts without your permission. The Sky is High Campaign Owners never receive Contributor’s credit card details or other payment information. We do not and will not sell your Personal Information.

If you are a Contributor, we share your name, email and shipping address with the Campaign Owner for the delivery of Rewards.

If you are a Campaign Owner, we may share your name, email address, and other contact information with any Contributor who alleges that you have failed to comply with your Campaign commitments such as Reward fulfillment.
